Terms and Conditions for the BBAG.Auction Platform

1. GENERAL PROVISIONS AND SCOPE
1.1 Scope of Application
These Terms and Conditions (T&C) govern the use of all services on bbag.auction, an online platform operated by 3forONE AG in technical partnership with BBAG e.V.
The T&C apply from the moment of registration or first use of the platform and are binding for all users.
1.2 Contractual Parties and Purchase Agreements
The BBAG e.V. is the sole contractual partner for the purchase of horses through auctions.
3forONE AG acts exclusively as the technical service provider and intermediary and is not a party to any purchase agreements or auction transactions.
1.3 Technical Implementation
3forONE AG provides the technical infrastructure for conducting online and hybrid auctions and is responsible for the technical functionality of the platform.
2. SUBJECT OF SERVICE
2.1 Technical Infrastructure
3forONE AG supplies and maintains the technical infrastructure required for online and hybrid auctions.
All responsibility for content, auction management, and bidder participation decisions lies solely with BBAG e.V.
3forONE AG assumes no liability for any decisions made by BBAG e.V. during an auction, including user suspensions or exclusions.
2.2 Disclaimer of Liability
3forONE AG shall not be liable for any damages or losses resulting from the use of the platform, except where caused intentionally or by gross negligence on its part.
This includes, but is not limited to, any decisions regarding user exclusion, deletion, or suspension made exclusively by BBAG e.V.
3forONE AG is not responsible for financial, legal, or technical consequences arising from such decisions and assumes no liability for auction content or terms.
2.3 Technical Requirements
Users are responsible for maintaining the technical equipment required to access the platform at their own cost.
3forONE AG is not liable for interruptions, delays, or malfunctions caused by a user’s individual hardware, software, or network conditions.
2.4 Livestream and Delays
The livestream offered during auctions may experience latency depending on the user’s internet connection and device performance.
3forONE AG accepts no liability for any delays or disruptions caused by individual user connections.
Bidders are advised to submit bids directly through the bid interface, which operates in real time.
2.5 Bidding Recommendations
To avoid potential delays, users are strongly advised to place bids directly via the on-screen bid panel rather than relying solely on the livestream, which may be subject to transmission latency.
2.6 Time Coordination and External Influencing Factors
The timing of all auction processes is governed by a centrally managed internal time reference of the platform, which is solely authoritative for determining the beginning, progression and conclusion of bidding phases.
Time indications or displays on users’ devices may differ from this internal time reference due to individual settings, technical processes or external factors. Such deviations lie outside the responsibility of 3forONE AG and have no effect on the actual execution of the auction.
A bid is valid only if it is fully received and registered by the systems of 3forONE AG within the relevant time frame. Users are responsible for ensuring the proper functioning of their own technical environment.
3forONE AG accepts no liability for delays, inaccurate displays or any disadvantages arising from local time deviations, external influences or technical conditions beyond our control. The platform is operated with due care and in accordance with recognised operational standards; however, external factors cannot be fully excluded.
3. REGISTRATION AND USER ACCOUNT
3.1 Registration
Participation in auctions requires prior registration via the registration form provided by 3forONE AG.
The decision to activate or suspend a user account rests solely with BBAG e.V.
3.2 Bid History and Data Access
During your participation in auctions, data relating to your bidding activity is processed. This includes information such as bids placed, highest bids, and the chronological sequence of your bidding activity.
This information is:

Sent to you by e-mail, for example when you place a bid, become the highest bidder, or successfully purchase a lot. Afterwards, BBAG e.V. will contact you directly for completion of the transaction.

Displayed anonymously in the frontend during live auctions:
– Online bids display the country flag and name of the bidder’s country.
– Floor bids are shown as “Hall” (without flag).
No disclosure of names or personal data occurs.
The stored data is processed by 3forONE AG as part of platform operations and may be used for auction handling, security, quality assurance, and system improvement.
The legal basis for processing is Art. 6 (1) (b) and (f) GDPR (performance of contract and legitimate interest).
3.3 Updating of Data
Users must promptly update any changes to their registration data in their user account.
3forONE AG is not responsible for disadvantages resulting from outdated or incorrect information.
3.4 Accuracy of Information
Users are responsible for providing accurate and complete information when registering or using the platform.
3forONE AG accepts no liability for damages arising from false or incomplete information.
In cases of false identity or misleading information, 3forONE AG reserves the right to suspend or delete the account without notice.
4. PARTICIPATION IN AUCTIONS
4.1 Contract Formation
Upon successful bidding, a contract is concluded exclusively between the user and BBAG e.V.
3forONE AG is not a contracting party and bears no responsibility for the resulting agreements.
4.2 Auction Rules and Participation Conditions
BBAG e.V. determines the rules and conditions for participation, including the right to exclude bidders.
3forONE AG has no influence over such decisions and assumes no liability for them.
4.3 Submitting Bids
Before submitting a bid, users must verify the amount displayed.
By clicking “Place Bid”, the user submits a binding offer.
After submission, bids cannot be withdrawn or modified.
4.4 Authority of the Auctioneer and Handling of Online Bids
The conduct of the auction and all decisions regarding the acceptance, prioritisation, evaluation or rejection of bids lie exclusively with the auctioneer or the authorised personnel acting on site.
The platform implements these decisions technically and has no influence on their content or formation.
This includes, in particular, the authority to prioritise floor bids over online bids and to reset, remove or disregard online bids upon instruction of the auctioneer or authorised personnel— even where the system may previously have issued automatic notifications such as confirmations or highest-bidder messages.
Such system notifications are for information purposes only and do not constitute any binding entitlement to recognition, consideration or award of a bid.
Users have no claim to the acceptance or evaluation of any online bid if the auctioneer makes a differing decision.
All liability of the platform operator for the rejection, non-consideration, deletion or invalidation of online bids is excluded.
5. LIABILITY AND INDEMNIFICATION
5.1 Liability of 3forONE AG
Liability is limited to intentional or grossly negligent acts.
3forONE AG shall not be liable for minor negligence, consequential damages, or loss of profit.
5.2 Exclusion of Liability for Auction Decisions
3forONE AG is not liable for actions or omissions of BBAG e.V., including user exclusions, auction structure, or contract fulfillment.
5.3 Indemnification
The user agrees to indemnify 3forONE AG against all third-party claims arising from any unlawful or improper use of the platform.
6. COPYRIGHT AND DATABASE RIGHTS
6.1 Intellectual Property
All platform content is protected by copyright and database law.
All rights remain with 3forONE AG or the respective rights holders.
6.2 Permitted Use
Use of the platform content is limited to its intended purpose.
Reproduction, distribution, or other use without prior written consent from 3forONE AG is prohibited.
7. TERM AND TERMINATION
7.1 Term
The user agreement is valid for an indefinite period and may be terminated by either party at any time unless otherwise agreed.
7.2 Termination by the User
Users may delete their account at any time.
Obligations toward BBAG e.V. that have already arisen remain unaffected.
7.3 Termination by 3forONE AG
3forONE AG may terminate the user relationship at any time and without notice if the user breaches these T&C or misuses the platform.
8. FINAL PROVISIONS
8.1 Amendments to the T&C
3forONE AG reserves the right to amend these T&C at any time with future effect.
Changes will be communicated via e-mail or upon next login.
If the user does not object within two weeks, the amendments are deemed accepted.
8.2 Assignment
Users may not transfer any rights or obligations under this agreement without prior written consent from 3forONE AG.
8.3 Governing Law and Jurisdiction
Swiss law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
The place of jurisdiction, insofar as legally permissible, is Feusisberg, Switzerland.
8.4 Validity of Current Version
Only the most recent version of these Terms and Conditions shall apply.
Upon publication of a new version, all previous versions lose validity.
8.5 Data Protection
3forONE AG processes personal data exclusively in accordance with applicable data-protection laws.
